ROBERT M. FRYE, SHAREHOLDER, ANNOUNCES A WIN IN THE INDIANA SUPREME COURT
600 LAND, INC. V. METROPOLITAN BOARD OF ZONING APPEALS OF MARION COUNTY, INDIANA, ET AL.
Indiana Supreme Court
600 Land Inc. v. Metropolitan Board of Zoning Appeals of Marion County, Indiana, et al.
49S05-0711-CV-513
The Indiana Supreme Court Reverses trial court judgment that 600 Land is required to get a special use permit for its transfer station. Rules 600 Land's proposed waste-transfer station is permitted use under the Industrial Zoning Ordinance without a special exception because it falls under the zoning of "motor truck terminal" and its use doesn't trigger the requirement for a salvage and storage use special exception.
